Privacy Policy

One item here needs a solicitor/accountant's specific judgment, not general boilerplate:

Whether the Privacy Act 1988 (Cth) applies to Bourke Group in full depends partly on annual turnover — businesses under $3 million generally qualify for a small business exemption unless an exception applies (e.g. trading in personal information, providing health services). This policy is written as if the Act applies in full, which is the safer default either way, but that assumption hasn't been confirmed. See §9.

1. Who we are

This website is operated by Bourke Infrastructure Group Pty Ltd, trading as Bourke Group(ABN 54 612 568 626), of 19 Latitude Blvd, Thomastown VIC 3074. This policy explains how we collect, use, store and disclose personal information, in line with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

2. Information we collect

When you submit a booking or enquiry we collect your name, phone number, email address, suburb/postcode, and details of the job you're enquiring about. If you complete a payment, our payment processor (Stripe) collects your payment details directly — we do not see or store your full card details. We collect only what's reasonably necessary for these purposes, and won't ask for more than that.

3. How we use it

We use this information to respond to your enquiry, schedule and carry out booked work (including creating a job in our field-service system, ServiceM8, for paid bookings), process payments, and — where you haven't opted out — to contact you about related services. We won't use it for an unrelated purpose without your consent, unless the law requires or permits it.

4. Direct marketing

If we send you marketing communications, each one will include a simple way to opt out — you can also opt out at any time by contacting us using the details in §8. We won't send marketing to you if you've opted out.

5. Who we share it with, and overseas disclosure

We share booking and payment details only with the service providers that run this site, strictly for the purposes above:

  • Stripe (payment processing) — a global payment provider that may process data outside Australia, including in the United States.
  • ServiceM8 (job scheduling) — an Australian company.
  • Supabase (secure database storage) — hosted outside Australia (our configured region is Mumbai, India).
  • Resend (booking notification emails) — sends your name, contact details and job information to our internal booking inbox by email; may process data outside Australia.

Where personal information is disclosed overseas, we take reasonable steps to ensure it's handled consistently with the Australian Privacy Principles by these established, reputable providers. We don't sell your information to third parties.

6. Data security

We take reasonable technical and organisational steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure — including restricting database access to authorised systems only. No method of transmission or storage is completely secure, but we aim to use industry-standard protections.

7. Data retention, access & correction

We retain booking records for as long as needed for the purposes above and to meet our legal and accounting obligations. You may request access to, correction of, or deletion of your personal information by contacting info@bourkegroup.au — we'll respond within a reasonable time and won't charge for a straightforward request.

8. Complaints

If you believe we've mishandled your personal information, contact us first using the details below. If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

9. Small business exemption

Businesses with annual turnover under $3 million are generally exempt from most of the Privacy Act, unless an exception applies. This policy is written as though the Act applies in full regardless, as the more protective approach — whether the exemption actually applies to Bourke Group has not yet been confirmed.
