Terms of Trade & Refund Policy

- Whether Victoria's Domestic Building Contracts Act 1995 applies to any of these jobs (it imposes mandatory contract terms, deposit caps and cooling-off rights for certain residential building work over $10,000) — see §9. This also affects the 48-hour cancellation window in §4: that figure is confirmed as Bourke Group's intended policy, but needs checking against the Act's requirements if it applies to a given job.
1. Who these terms apply to
These terms apply to every booking, order or job made through this website with Bourke Infrastructure Group Pty Ltd trading as Bourke Group (ABN 54 612 568 626), a licensed plumbing and gas fitting contractor based in Victoria, Australia. By submitting a booking or making a payment, you agree to these terms.
2. Pricing & quotes
Prices shown on this site are indicative "from" prices in Australian dollars, inclusive of GST where stated. Final pricing is confirmed before work begins and may vary based on site access, existing plumbing/gas configuration, and compliance requirements identified on inspection. Commercial and non-standard jobs are quoted individually following a site assessment.
3. Payment terms
Supply only orders are paid in full at checkout and do not include installation. Supply + install bookings and paid service call-outs (drain cleaning, gas fitting, general plumbing) require payment — a deposit or the full call-out fee — at the time of booking to secure a trade slot; any balance is payable on completion of the work. Payments are processed securely by Stripe; we do not see or store your full card details.
4. Cancellations & refunds
Supply-only orders may be cancelled for a full refund before dispatch; once dispatched, standard return conditions apply. Deposits and call-out fees for Supply + Install bookings and service call-outs are refundable in full if you cancel more than 48 hours before your scheduled appointment; they are non-refundable for cancellations within 48 hours or a missed appointment, as this holds a booked trade slot. This clause does not limit any right you have to a refund under the Australian Consumer Law — see §6.
5. Warranty
Manufacturer warranties apply to all supplied products, on the terms set by that manufacturer. Installation workmanship is covered under our own workmanship warranty — ask us for the current period at time of booking. Nothing in this section limits the consumer guarantees described in §6.
6. Your consumer guarantees (Australian Consumer Law)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract and, to the extent permitted by law, receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to have services re-performed or, to the extent permitted by law, to cancel the contract and receive a refund, if the service fails to be provided with due care and skill or within a reasonable time. For goods, you are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage — and to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies these guarantees.
7. Licensing & compliance
All licensed plumbing and gas fitting work is carried out under plumbing licence VIC 103182, registered with the Victorian Building and Plumbing Commission (formerly the Victorian Building Authority), and certified to the relevant Australian/New Zealand Standards — including AS/NZS 5601 (gas installations) and AS/NZS 3500 (plumbing and drainage) as applicable to the work performed. A Compliance Certificate is lodged for notifiable plumbing work as required by Victorian regulations.
8. Liability
To the extent permitted by law, and subject always to §6, our liability for any claim arising from these terms is limited to the amount you paid for the relevant goods or services. We are not liable for indirect or consequential loss. We hold public liability insurance of $20,000,000 and professional indemnity insurance of $20,000,000 — ask us for details.
9. Domestic building work (Victoria)
Some residential building work in Victoria valued over $10,000 is subject to the Domestic Building Contracts Act 1995 (Vic), which can require a compliant written contract, cap deposits, and grant a cooling-off period. Whether this applies to a particular job depends on its nature and value — this has not yet been confirmed by a solicitor for our specific services, and a compliant contract will be provided separately for any job it applies to.

If you have a complaint, contact us first using the details below so we can try to resolve it directly. If we can't resolve it, you may contact Consumer Affairs Victoria or, for plumbing-specific complaints, the Victorian Building and Plumbing Commission.
